Gambling Laws in Nepal: Do People Get Prosecuted Over Gambling

Gambling has been on a steady rise all over the world for quite some time now. However, even though there are more and more countries opening their doors to this pastime, not all are ready and willing to accept gambling.

Aside from government-run lotteries, gambling in Nepal is heavily prohibited. So much so, in fact, that people who are caught gambling may expect to pay a hefty fine and potentially even face some jail time.

The law – Simple breakdown

According to Clause 125 of the Criminal Code, 2074, any and all forms of gambling are strictly prohibited in Nepal. Any first-time offenders that are found guilty may end up facing a jail sentence of up to three months, as well as a hefty fine of up to Rs 30,000. Second-time offenders may be looking at a year-long jail sentence, as well as a Rs 50,000 fine.

However, authorities also state that, while it is not entirely possible to fully control physical gambling, online gambling has made things even more difficult. Namely, due to the lack of necessary resources and effective policies, putting a stop to online gambling has proven to be virtually impossible. 

Some workarounds

Of course, according to the golden rule, if you so strongly prohibit something, people will naturally want to partake in it even more. That’s why some individuals found creative ways to bypass these gambling restrictions. 

In one instance, people resorted to using various eWallets and similar online payment processors to make deposits and withdrawals from online casinos. Others resorted to cryptocurrency since these transactions are impossible to trace and tap into.

What will the future bring?

Currently, the Nepalese government is appealing to banks to not accept any transactions related to online gambling, in the hopes of limiting – and even putting a stop – to these activities. However, gamblers don’t really need to use banks in order to make use of any of their potential winnings. 

Even though there are still no hints of the Nepalese government lifting the ban on gambling, the fact of the matter is that this is something people may expect to happen in the not-so-distant future.
